{"id":952,"date":"2022-04-24T21:11:18","date_gmt":"2022-04-24T21:11:18","guid":{"rendered":"http:\/\/www.apus.uno\/noticias\/?p=952"},"modified":"2022-04-24T21:12:58","modified_gmt":"2022-04-24T21:12:58","slug":"el-supremo-obliga-a-hacienda-a-pagar-las-devoluciones-tributarias-que-no-haya-devuelto","status":"publish","type":"post","link":"https:\/\/www.apus.uno\/noticias\/2022\/04\/24\/el-supremo-obliga-a-hacienda-a-pagar-las-devoluciones-tributarias-que-no-haya-devuelto\/","title":{"rendered":"El Supremo obliga a Hacienda  a pagar las devoluciones tributarias que no haya devuelto"},"content":{"rendered":"\n<p>Muchos aut\u00f3nomos llevan esperando&nbsp;m\u00e1s de un a\u00f1o a que Hacienda les ingrese la&nbsp;devoluci\u00f3n de un impuesto.<\/p>\n\n\n\n<p>El Tribunal Supremo acaba de habilitar el uso de una&nbsp;nueva v\u00eda para reclamar las devoluciones tributarias en todos aquellos casos en los que la Agencia Tributaria utiliza el&nbsp;silencio administrativo.<\/p>\n\n\n\n<p>La medida permitir\u00eda a cualquier contribuyente,<strong> <\/strong><strong>acceder al cobro de&nbsp;un pago que est\u00e1 pendiente desde hace m\u00e1s de seis meses<\/strong> y sobre el que no tienen respuesta de la Administraci\u00f3n.<\/p>\n\n\n\n<p>La sentencia emitida por el Tribunal Supremo el pasado 4 de marzo de 2022 dice: \u201cSi Hacienda no hace nada, es decir si no te devuelve el dinero y tampoco inicia un procedimiento de comprobaci\u00f3n en seis meses. Cuando se termine ese plazo, se le reconoce autom\u00e1ticamente el cr\u00e9dito al aut\u00f3nomo y <strong>s<\/strong><strong>e establece la obligaci\u00f3n de que Hacienda tiene<\/strong><strong> que<\/strong><strong> pagar esa deuda<\/strong><strong>\u201d.<\/strong><\/p>\n\n\n\n<p>Gracias a esta sentencia, cualquier contribuyente pueden llevar el caso directamente a&nbsp;la&nbsp;v\u00eda Contencioso-Administrativa, para <strong>obligar a la Agencia Tributaria abonar&nbsp;el importe que debe, m\u00e1s los intereses por el retraso en el pago y las costas del proceso judicial<\/strong><strong>\u201d.<\/strong><\/p>\n\n\n\n<p>Este procedimiento puede ser utilizado <strong>en todas aquellas devoluciones tributarias que deban ser abonadas por la&nbsp;Administraci\u00f3n y en las que \u00e9sta se retrase en exceso<\/strong><strong>.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Dos requisitos para utilizar el nuevo procedimiento<\/h2>\n\n\n\n<p>Las personas y los &nbsp;trabajadores por cuenta propia interesados en hacer uso de este nuevo procedimiento deben cumplir dos requisitos:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>El primero, tiene que existir siempre&nbsp;una obligaci\u00f3n de la Administraci\u00f3n a realizar el pago.<\/li><li>El segundo requisito, es que pasen tres meses desde que se hubiera reclamado por v\u00eda administrativa la devoluci\u00f3n y no se hubiera obtenido una respuesta.<\/li><\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">\u00bfA qu\u00e9 otros supuestos se pueden extrapolar esta decisi\u00f3n del Supremo?<\/h4>\n\n\n\n<p>El nuevo mecanismo de reclamaci\u00f3n de deudas tributarias, tambi\u00e9n podr\u00e1 ser utilizado por los contribuyentes para desbloquear aquellas situaciones en las que el&nbsp;Tribunal Econ\u00f3mico Administrativo le haya dado la raz\u00f3n y sin embargo la Administraci\u00f3n -local, auton\u00f3mica o central- retrase en exceso la ejecuci\u00f3n de dicha resoluci\u00f3n.<\/p>\n\n\n\n<p>Fuente:<\/p>\n\n\n\n<p><a href=\"https:\/\/www.autonomosyemprendedor.es\/articulo\/tus-finanzas\/supremo-autoriza-autonomos-reclamar-devoluciones-tributarias-que-hacienda-ha-pagado\/20220421161238026548.html\">https:\/\/www.autonomosyemprendedor.es\/articulo\/tus-finanzas\/supremo-autoriza-autonomos-reclamar-devoluciones-tributarias-que-hacienda-ha-pagado\/20220421161238026548.html<\/a><\/p>\n\n\n\n<p>Temas de Interes:<\/p>\n\n\n\n<p><a href=\"https:\/\/www.apus.uno\/noticias\/2020\/12\/05\/la-autoobservacion\/\" target=\"_blank\" rel=\"noreferrer noopener\">La Autoobservaci\u00f3n<\/a><\/p>\n\n\n\n<p><a href=\"https:\/\/www.apus.uno\/noticias\/2020\/12\/05\/la-muerte\/\" target=\"_blank\" rel=\"noreferrer noopener\">La Muerte en Marcha<\/a><\/p>\n\n\n\n<p><a href=\"https:\/\/www.apus.uno\/noticias\/2020\/12\/05\/el-viaje-astral\/\" target=\"_blank\" rel=\"noreferrer noopener\">El viaje en Astral<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Muchos aut\u00f3nomos llevan esperando&nbsp;m\u00e1s de un a\u00f1o a que Hacienda les ingrese la&nbsp;devoluci\u00f3n de un impuesto.
